    A DOT SAP plays a key role in the Return to Duty process after a DOT violation. The DOT SAP evaluates safety sensitive employees and makes recommendations. The SAP also decides when an individual has complied with those recommendations. At that point, an employer may consider returning the person to safety sensitive work. This role is defined in 49 CFR Part 40 and explained in the DOT SAP Guidelines.

    Definition of a DOT SAP

    Under DOT regulation, a SAP evaluates employees who violate DOT rules. The SAP then recommends education, care, and follow up testing. A DOT SAP is not an advocate for the employer or the employee. The SAP’s role is to protect the public interest in safety. They do this by providing a evaluation, recommending appropriate services, and creating a follow up testing plan to support safe return to duty.

    Who Can Serve as a DOT SAP

    Not every professional is permitted to act as a DOT SAP. Federal rules require that a SAP hold specific credentials and meet standardized qualification criteria before performing any SAP functions.

    To be qualified as a DOT SAP, an individual must have one of the following credentials:

    • Licensed physician Doctor of Medicine or Doctor of Osteopathy
    • Licensed or certified social worker
    • Licensed or certified psychologist
    • Licensed or certified employee assistance professional
    • State licensed or certified marriage and family therapist
    • SUD counselors certified by an organization recognized by DOT and listed on the ODAPC SAP page

    Required Knowledge and Experience for DOT SAPs 2026

    In addition to holding an appropriate credential, a DOT SAP must meet specific knowledge and experience requirements. 

     

    The SAP must also be knowledgeable in several regulatory and safety related areas:

    • The SAP function as it relates to employer responsibilities for safety sensitive duties
    • DOT wide regulation 49 CFR Part 40
    • The specific DOT agency regulations that apply to the employers and employees being evaluated for example FMCSA, FAA, FRA, FTA, PHMSA, USCG
    • The DOT SAP Guidelines and any significant updates to those guidelines

    The guidelines make clear that degrees and certificates alone do not satisfy the knowledge requirement. SAPs are expected to stay current by subscribing to the ODAPC email list, monitoring regulatory changes, and maintaining familiarity with applicable DOT guidance materials.

    Qualification Training and Examination 2026

    Before performing SAP duties, a DOT SAP must complete specific qualification training and pass an examination that covers all required content areas.

     

    Qualification training must include at least the following elements, as outlined in 49 CFR 40.281 and the SAP Guidelines:

    • Background and rationale of the DOT testing program
    • Detailed coverage of 49 CFR Part 40 and DOT agency specific testing rules
    • Key DOT drug testing requirements, including collection procedures, laboratory analysis, Medical Review Officer review, and common testing problems
    • Key DOT testing requirements, including test methods, roles of technicians and screening technicians, and common issues in testing
    • SAP qualifications, responsibilities, and prohibitions
    • The SAP role in the Return to Duty process, including initial evaluation, recommendations, follow up evaluation, continuing care recommendations, and follow up testing plans
    • Appropriate consultation and communication between the SAP and employers, MROs, and treatment providers

    After completing qualification training, the practitioner must pass an examination that a nationally recognized professional or training organization administers. The exam covers all required qualification subjects, and a test evaluation organization validates it in line with DOT requirements.

    Continuing Education Requirements 2026

    DOT regulation and the SAP Guidelines establish an ongoing professional development requirement for DOT SAP. During each three year period after successfully completing SAP qualification training and the examination, the SAP must complete at least 12 hours of professional development, such as continuing education units, that are directly relevant to performing SAP duties.

     

    DOT regulations permit only SAPs who remain current with both clinical best practices and federal regulatory changes to continue acting in the DOT SAPs.

    The DOT SAP Guidelines describe the SAP as the gatekeeper for the Return to Duty process. SAP decisions significantly influence whether an employee who violated DOT rules may safely return to safety sensitive work.

    The main responsibilities of a DOT SAPs include:

    1. Comprehensive evaluation

    The SAP conducts a face to face assessment, either in person or via secure real time audio visual telehealth. During this evaluation, the SAP gathers a detailed history, mental status assessment, and a review of the circumstances of the DOT violation, including any prior violations. Using this information, the SAP then determines recommendations.

     

    1. Recommendation

    The SAP must recommend a course of education or care for every individual who has violated a DOT regulation. The recommendation must be individualized and designed to protect public safety if the employee returns to safety sensitive duties.

    1. Referral and coordination

    After determining the level of assistance, the DOT SAP acts as a referral source to help the employee enter an acceptable program. The SAP is expected to know qualified providers, and payment considerations, and employer policies related to time off and benefit

    1. Follow up evaluation

    Before an employer can consider Return to Duty testing, the SAP conducts a follow up, face to face evaluation. The purpose is to decide whether the employee has complied with the recommended education or treatment. After this visit, the SAP issues a written report to the employer. The report states whether the employee has complied and whether the SAP considers the employee ready for Return to Duty testing, if the employer chooses to proceed.

    1. Follow up testing plan

    For each employee who will return to safety sensitive duties, the SAP designs a written follow up testing plan. The plan includes at least six unannounced tests in the first 12 months after the employee returns to safety sensitive work. The plan may extend up to 60 months when needed. The SAP alone decides the number and frequency of tests beyond the minimum. The employer carries out this plan, but the SAP remains responsible for its design. The plan must be clear and specific enough for the employer to follow. The plan is not shared with the employee to preserve the deterrent effect of unannounced testing.

    Neutral Role and Public Safety Focus

    The DOT SAP holds a neutral position. In fact, Part 40 and the SAP Guidelines specify that the SAP is not an advocate for either the employer or the employee. Instead, the SAP’s duty is to safeguard the traveling public by making sound, regulation compliant recommendations that address the employee’s problems and support safe performance of safety sensitive functions.

     

     

    When performing evaluations and making recommendations, the SAP must accept the verified test result or other DOT violation as established. In addition, the SAP may not change recommendations based on personal views about testing programs or on employee arguments that the test was unfair or inaccurate. Instead, the Medical Review Officer holds responsibility for verifying test results, and the SAP role begins only after that verification is complete.

     

     

    How a DOT SAP Supports Drivers and Employers 2026

     

    For CDL drivers and other DOT regulated employees, a qualified DOT SAP guides the required step after a violation. In this context, these employees must work with a DOT SAP, and this step, in turn, creates a structured pathway back toward safety sensitive work.
